Under the Staff Regulations of Officials of the European Communities and the Conditions of\nEmployment of Other Servants adopted by Council Regulation 259\/68, as amended by\nCouncil Regulation 723\/2004 (directly applicable in each Member State of the European\nUnion), officials, temporary staff or contract staff who leave the service for reasons other\nthan death or invalidity and who are not entitled to an immediate or deferred retirement\npension are required, upon leaving the service, to transfer the actuarial equivalent of their\npension rights accrued under the European Communities' pension scheme to a pension\nscheme offering similar rights.<\/p>

The transfer to a private pension insurance scheme or other pension fund must comply with\nthe criteria set out in Article 12(1)(b) of Annex VIII to the Staff Regulations, which guarantee\nspecific conditions:<\/p>

  1. that the person concerned shall not be entitled to a lump-sum refund;<\/li>

  3. their dependants will be entitled to survivor's benefits;<\/li>
  4. that transfer to another insurance company or fund will only be authorized under the\nsame conditions as those described in points 1) to 3) above.<\/li><\/ol>
